The classic game publisher Atari, is suing Nestle over a Kit Kat (now removed) online Kit Kat commercial which showed a game similar to Atari’s 1985 classic Breakout. Kit Kats take on the game replaced the breakout block replaced with Chocolate Kit Kat bars. View Atari’s full complaint here.
Atari’s suit is seeking an award of three times Nestle's profits from the advert as well as additional punitive damages.
